The Washington State Lawyer, who is challenging the validity of the states online gambling law, has hit a bump.
Evidently the State of Washington is in delay mode. The state has filed for an extension to allow them to conduct discovery on the case. Lee Rousso contends that it is just an excuse to delay the legal proceedings, as the law suite is based solely on legal foundations.
As reported by Mr. Rousso himself, approximately a week ago he was served with interrogatories, or a questionnaire. The information being requested is less of an interest in the constitutional challenge, and more of an interest in his personal business. He speculated the intention was to charge him with a crime of some kind.
It is reported that Lee Rousso will be filing a motion to strike the interrogatories, close discovery, and set a hearing date. The Poker Players Alliance Representative (PPA) is hoping to have the date set for the end of October, planning on filing the brief by September 28th. In the same update and report, it is also mentioned that the court will be requested to impose sanctions on the State for bad faith conduct of litigation.
Lee Rousso is anticipating a successful hearing, one way or another, as the media will be covering the issue, and both exposure and a positive ruling from the judge can measure success.
